COLOR VARIATIONS: Due to the colorant process, we ask that if you purchase your product in stages, understand that there may be slight shade variations.
COLOR LOSS/DECOMPOSITION: This product is guaranteed not to decompose or totally lose its color for a period of 15 years from date of Purchase, provided the Purchaser has used the product only for general landscape or playground purposes. Some fading of color over time is expected and is not covered under this warranty. Further, additional incurred costs due to color loss, such as labor for removal of original product, installation of replacement product and the cost of incidental or other materials or expenses are not covered under this warranty. No other guarantee or warranty is expressed or implied except as stated herein.
STEEL CONTENT: RubberStuff® Mulch is guaranteed to be 99.9% Steel-Free. This guarantee is conditioned upon RubberStuff® rubber mulch having been properly installed and maintained by end-user in accordance with CPSC (Consumer Product Safety Commission) installation and maintenance guidelines and with written recommendations for installation available from American Rubber Technologies, Inc.
American Rubber Technologies entire liability, and the purchaser’s sole remedy, in the unlikely event that RubberStuff® rubber mulch does not conform to this guarantee, shall be the removal of residual steel traces via portable magnets, or the replacement of the defective RubberStuff® rubber mulch and shall not include the removal costs or installation costs or consequential damages or refund. No other guarantee or warranty is expressed or implied except as stated herein. Vandalism, or any abnormal use shall void this Lifetime Guarantee, and ART shall have no responsibility with respect to damage resulting therefrom. Under no conditions shall American Rubber Technologies, Inc. be liable for any damages whatsoever arising from the use of, or inability to use RubberStuff® rubber mulch, even if American Rubber Technologies, Inc. has been advised of the possibility of such loss.
American Rubber Technologies, Inc. strongly urges all purchasers of our mulch to comply with all installation recommendations, and for RubberStuff® Playground, the recommendations in the CPSC Handbook for safety and liability purposes. Failure to install any RubberStuff® rubber mulch product properly and to maintain the recommended levels invalidates its guarantee.

- Small sample(s) of the product in question.

RETURNS POLICY: Merchandise must be returned within 30 days in unopened, original
packaging. Returns shipping charges are the responsibility of the
customer and returns must be clearly marked with RMA number received
from American Rubber Technologies. RMA may be obtained by emailing sales@americanrubber.com
stating reason for return. Proof of purchase from RubberStuff Mulch
(American Rubber Technologies) or authorized dealer will be required
and you may be required to submit sample of material to qualify for RMA.
If
damaged upon arrival you have the right to refuse the order, however
please be aware in cases other than damages that may have happened
during transit - you will be responsible for BOTH delivery and return
shipping charges without an RMA number as explained above. Please see Shipping Terms (below) for more information on shipping claims.
As
all sales are “Freight On Board” (FOB - meaning that title ownership of
the goods transfers to customer when goods are loaded onto truck at
seller’s facilities). American Rubber Technologies is not responsible
for guaranteeing any specific delivery date.
SHIPPING TERMS: American Rubber delivers to all 48 states within the continental US. For inquiries from all other locations please see below. Order-to-delivery time can range from 3-14 days depending on delivery location and product availability. By placing an order for any product – customer authorizes American Rubber Technologies, Inc. to hire a freight trucking company on customer’s behalf. All sales are “Freight On Board” (FOB) meaning that title ownership of the goods transfers to customer when goods are loaded onto truck at seller’s facilities. Seller is not liable in the unlikely event that loss or damage occurs thereafter. Customer is responsible for incoming inspection of the goods at the time of delivery and for noting any shortages or damage to the goods on the freight slip that customer must sign to receive the delivery. American Rubber Technologies will assist customer with filing freight claim and receiving replacement product in the unlikely event of a damaged or missing goods problem. Once the freight slip is signed 'received in good order' by the customer, there is no possibility of filing a successful freight damage claim. Motor freight company will call customer ahead of time to schedule an appointment to deliver the goods. Customer or customer's representative must be present at time of delivery. Customer may be responsible for an additional re-delivery fee if the truck arrives with the goods but the customer is not present for the delivery. Customer is responsible to assure that a 48ft-long freight truck is able to get to the provided shipping address, or otherwise make arrangements to pick up the goods from the local freight terminal or transfer the goods at a mutually agreed upon location that the freight truck can get to - most freight companies do not have smaller trucks. It is the customer’s responsibility to facilitate the delivery and to assure that delivery of the goods to their shipping address by a freight truck is possible. Pricing will include for lift gate/residential service, therefore LTL carrier will unload pallet at curbside in front of the house. It will be customer’s responsibility to move it from there.
Canada, Alaska, Hawaii, Puerto Rico, Other locations outside Continental US: Customers residing outside of the continental US can also hire their own independent forwarding agent that is based in the US. In this case, American Rubber Technologies will guarantee delivery to the agent's US address. American Rubber Technologies may be able to provide customer with a referral to a forwarding agent that was used by one of our past customers in your location.
